Should Clients Fit in the Collaborative Process or Should the Collaborative Process Fit Our Clients?

Last September, during our Introductory Learning Program, Zanita Zacks-Gabriel shared this thought: if you walk the walk and talk the talk then making Collaborative cases becomes easier.  You need to have confidence in what you are teaching your potential client. 

We should not be assessing whether our clients would be good fits for the Collaborative Process.  EVERYONE is a good fit for the Collaborative Process.  Your initial and on-going assessments of your client should be what challenges might your client and their spouse bring to the Process.  If they seem to be a square peg and don’t quite fit in the round hole of the Process, then the team must work to shave the corners and help the peg fit.

When we learn about option building and interest based negotiations we are encouraged to “think outside the box” to achieve settlement.  We should not be constrained by the law.  The same holds true regarding the Process itself.  We should not be constrained by any specific methods or Process procedures.  We should mold the Process around the needs of our clients.
