In the Collaborative Process be Flexible, Especially with Fees

One of the keys to a successful Collaborative matter is the flexibility of the team.  We mold our cases to the needs of the clients.  Whether that means more team meetings or less team meetings and more individual sessions, we must be willing to change our approach with each new matter.

The same flexibility should be considered in your fees.  Once again, it is critical to mold the case to the needs of the clients.  While I am not suggesting that you compromise your fees, keep in mind that in the Collaborative process there are little or no accounts receivable.  And time spent in Collaborative cases, especially these days when everything is done from the comfort of your desk via Zoom, is much more efficient.  

Probably one of the best ways to show flexibility to the clients is by decreasing or even eliminating the need for a retainer.  Put yourself in the client’s shoes and think about the cost to start the Process.  Have the client provide a credit card and agree that you may charge the card monthly, or after every team meeting at your discretion.  This should be done with the knowledge of the professional team as it becomes critical for the team to address fees throughout the case.
